A yearlong review of Riverside County’s embattled child protective services agency — criticized for failing to protect vulnerable children such as a Corona boy whose father has been charged with his murder — concludes that the office is improving.

The seven-page report, released Tuesday, Oct. 1,  follows more than a year of headlines involving children on the Department of Public Social Services radar who suffered horrific outcomes, including a toddler found hugging her dead infant sibling’s mummified corpse and a girl who was repeatedly raped and gave birth to her rapist’s child.

In an interview Tuesday, social services Director Sarah Mack said the review builds upon steps her agency has already taken to improve staff training and oversight to protect vulnerable children.

“Any harm to a child is a critical incident,” Mack said.

County officials declined to talk about individual cases, citing privacy rules.

The review was completed by an outside law firm and looked at lawsuits filed against social services’ Children’s Services Division. It states that the agency “has made significant strides over the past five months to ensure the safety and well-being of children.”

The office has initiatives over the next 18 months to continue improving the department and to give social workers “the consistent support and tools they need to make timely, appropriate decisions” for children, the report states.

Lawsuits alleged that botched casework by county social services workers endangered the children in these two high-profile cases. Both cases were settled for more than $11 million. In addition to those lawsuits, the county since 2009 has paid out almost $9 million to satisfy judgments and settlements in lawsuits involving its child protective services, county records show.

Also, records released by the court after a lawsuit by the Southern California News Group and other media outlets show social workers checked on 8-year-old Noah McIntosh of Corona at least three times before his March 2019 disappearance, but did not remove him from his home despite reports his hands were zip-tied behind his back and he was dunked in cold water and that he showed up to school without pants.

Noah’s father has been charged with his son’s murder.

Social Services Director Susan Von Zabern left her job last September, shortly before the review was announced. Mack, who was the county’s assistant chief executive of human services at the time, took over as interim director before being named permanent director earlier this year.

Attorney Christie B. Swiss, of Collins, Collins, Muir & Stewart conducted the review, which examined lawsuits against the agency from 2008 to 2018. It cost $147,000, Riverside County spokeswoman Brooke Federico said.

‘Just follow it’

The county saw claims similar to those in other counties, the review found. The largest category – 38 claims between 2008 and 2018 – dealt with allegations of children being unlawfully removed from their homes.

Of those 38 claims, 31 involved removals done without a warrant – an order from a juvenile court judge –  with all but two occurring before January 2015, according to the review. To prevent future complaints of children being illegally removed from their homes, Mack said a new process that involved the courts at an earlier point was put in place in 2015.

“It is always a fine balance where there can be criticism of removing the child or of not removing the child,” she said.

But San Diego attorney Shawn McMillan, who has represented clients who sued the county alleging their children were illegally taken from their homes, criticized the county. Three of his clients received more than $2.1 million combined.

“A government worker cannot lawfully remove a child from the custody of its parents without a warrant unless at the time of the removal that worker is in possession of specific and (explainable) facts to show that the child is in immediate danger … AND there is no lesser intrusive alternative means of protecting the child from that SPECIFIC injury,” McMillan wrote in an email.

McMillan added: “It only takes an hour or two to get a warrant. In some counties even less time. Regardless, the law is clear and simple, and is in place for important reasons. Just follow it.”

Reacting to the report’s findings, Board of Supervisors Chairman Kevin Jeffries said in an email that it points to two challenges for the county: “taking children from their parents will always be controversial either because it shouldn’t be done, or it’s being done too late, and second, human error will almost always be found in some of the most tragic cases occurring across our county and the state.”

On the positive side, he said, the number of wrongful removal claims has fallen, thanks to new procedures, training and better supervision.

‘A difficult job’

The review outlines improvements to prevent future lawsuits, including more staff training. Mack said her agency has also expanded its case review team and broadened the scope of cases that come under further scrutiny so that social workers and supervisors get immediate feedback that can be used to better protect children.

A big problem is that social workers are overworked and their departments are understaffed, according to a lawyer who has sued Southern California counties on behalf of social workers.

“In all of my lawsuits I see the same pattern,” Megan Richmond said. “Where social workers are blamed; they are not properly paid; they are working massive hours to handle unmanageable caseloads of extremely sensitive and emotionally charged situations where children or the elderly are being abused or worse.”

Mack acknowledged the need to hire more staff.

Mack said she could not cite a specific number of people the department needs to hire. She added that the office is working to recruit future social workers but that the entire state is facing a shortage.

Retaining social workers while expanding their ranks is also a challenge, Mack said, adding the department cut its social worker attrition rate from roughly 20% three years ago to about 10% today.

Those who choose a career in social work  — which is difficult — “are incredibly caring individuals whose goal is to protect children and dependent adults,” she said.

Social workers and the county “… realize when a tragedy has occurred … the department and the staff will look at their practice and we’ll look at all of the events to prevent abuse from happening again.”

This is the first working level of the professionally trained social caseworker. Training for this level may be acquired through a Master's degree or equivalent experience. Incumbents of positions in this class carry a specialized caseload dealing with individual and family problems that require possession of advanced social work skills and techniques designed to motivate individuals and families toward meeting the Title XX goals of self-support and self-care, and to restore or improve social functioning.

Incumbents of some positions in this class will be required to have a Master of Social Work, Master in Social Welfare, or a Master's degree in social or behavioral sciences, or social/human services.

Children's Social Services Worker V:

Under general direction, performs the most responsible and difficult social service casework dealing with highly complex individual and family problems; provides leadership as a program consultant in the utilization of casework concepts and methodology; and performs other related duties as required.

This is the journey level of the professionally trained caseworker. Positions in this class are characterized by responsibility for performing the full scope of social service casework requiring difficult diagnosis and intensive treatment services. The Children's Social Services Worker V is distinguished from the Children's Social Services Supervisor II by the latter's responsibility to supervise staff performing casework.

Incumbents of some positions in this class will be required to have a Master of Social Work, Master in Social Welfare, or a Master's degree in social or behavioral sciences, or social/human services.


Minimum Qualification Requirements:

Children's Social Services Worker III:

OPTION I

Education: Possession of a Bachelor of Social Work degree from an accredited college or university.

OR OPTION II

Education: Possession of a Bachelor's degree from an accredited college or university in social welfare, social or behavioral sciences, social/human services, counseling or a closely related field.

AND

Experience: Two years of case planning/case management experience in a social services agency performing duties equivalent to Riverside County's Social Services Worker II classification (refer to Supplemental Information below).

OR OPTION III

Education: Possession of a Master's degree from an accredited college or university in social or behavioral sciences, social/human services, or a closely related field.

OPTION I

Education: Possession of a Master of Social Work or Master in Social Welfare degree from an accredited college or university.

OR OPTION II

Education: Possession of a Master's degree in Psychology, Marriage and Family Therapy or Counseling from an accredited college or university, which included 300 hours of field placement experience.

OR OPTION III

Education: Possession of Master's degree from an accredited college or university in social or behavioral sciences, social/human services, or a closely related field.

AND

Experience: One year of post-master's degree social case planning/case management experience (assessments and case plans for abuse and neglect cases) in a public or private agency in a class equivalent to Riverside County's Children's Social Services Worker III/IV or Social Services Worker III/IV.

OR OPTION IV

Education: Possession of a Bachelor's degree from an accredited college or university in social welfare, social or behavioral sciences, social/human services, counseling or a closely related field.

AND

Experience: Three years of experience equivalent to Riverside County's Children's Social Services Worker III or Social Services Worker III classification in a Department of Public Social Services. The experience should include the following duties as a primary portion of the assignment: assessments, case planning/case management, and court reports.
